Bansumwineandliquor.com (hereinafter referred to as the “Website” or “Site”) is an online retail platform owned and operated by Ban Sum Wine & Liquor, a New York company (hereinafter “Ban Sum Wine & Liquor”). All prices are subject to change without prior notice. Ban Sum Wine & Liquor is not responsible for typographical errors and reserves the right, at its sole and absolute discretion, to correct any pricing or descriptive inaccuracies. Ban Sum Wine & Liquor further reserves the right to revise these terms and conditions at any time without notice. Your continued access to or use of the Website following any such modifications constitutes your acceptance of the revised terms and conditions. If you do not agree to these terms, please do not use this Website. In the event you breach any of these terms and conditions, or if you are under 21 years of age, your right to use this Website shall automatically terminate.

All captions, titles, or section headings contained herein are for reference purposes only and shall not affect the interpretation of any provision within this document. Wherever the terms “including” or “include” appear, they shall be construed to mean “including without limitation” or “include without limitation,” as applicable.

Shipping Policy

Shipping Insurance

Ban Sum Wine & Liquor Shipping Insurance must be purchased at the time of checkout in order to cover lost, stolen, or damaged shipments.

Spillage, minor damage, or cosmetic imperfections may occur during transit. Ban Sum Wine & Liquor is not responsible for such minor damages.

Ban Sum Wine & Liquor is not liable for any lost shipments, including, but not limited to, packages lost as a result of hold requests, address errors, or delivery rescheduling.

If a package is returned due to failed delivery, a twenty-five percent (25%) restocking fee will be deducted from the refund amount. Shipping costs are nonrefundable.

If a package is returned to Ban Sum Wine & Liquor in damaged condition due to failed delivery attempts or refusal of delivery, the customer shall be responsible for the full cost of the order.

You must be at least 21 years of age to place an order, and a signature from an individual at least 21 years of age is required upon delivery.

The customer bears sole responsibility for compliance with all local and state laws governing the shipment and receipt of alcoholic beverages.

All orders placed Monday through Friday will be shipped within one (1) to nine (9) business days.

All Ground shipments placed Monday through Friday before 2:00 p.m. EST will be shipped within one (1) to nine (9) business days. Shipments placed during holiday periods may experience delays. If an item is not in stock, delivery may be further delayed.

All Express shipments placed Monday through Friday before 2:00 p.m. EST will be shipped the following business day, subject to the same possible holiday and inventory delays.

Orders placed on Friday after business hours, Saturday, or Sunday will be processed and shipped within one (1) to nine (9) business days beginning the following Monday.

Our warehouse is located in Southern New York.

We do not ship outside the United States.

Ban Sum Wine & Liquor does not ship to P.O. boxes under any circumstances.

Purchase of Alcoholic Beverages

By placing an order, you represent and warrant to Ban Sum Wine & Liquor that you are at least 21 years of age and authorize Ban Sum Wine & Liquor to charge your payment method for the total amount of your order.

You further represent that all items purchased from this Site are for personal consumption and not for resale. Applicable state sales tax will be assessed based on the destination state’s requirements; otherwise, New York sales tax will apply. You may also be responsible for any local taxes imposed by your state or municipality.

If any item ordered is out of stock, Ban Sum Wine & Liquor will issue a refund for that portion of your order.

Once an order is placed, any request for an address change must be made immediately. Ban Sum Wine & Liquor will make reasonable efforts to accommodate such requests but does not guarantee that an address change can be completed. All associated costs and fees will be the responsibility of the customer.

Title to Goods

Laws regarding the sale and shipment of alcoholic beverages vary from state to state. Title to all alcoholic beverages purchased through this Site passes to you in the State of New York once the goods are collected by the common carrier. You become the legal owner of the goods when your funds have cleared.

Shipping Laws

You are solely responsible for complying with all state and local laws governing the receipt of alcoholic beverages shipped from outside your state. You represent that you have obtained all necessary permissions, paid any required fees, and are legally entitled to receive such shipments. You further represent that both you and any person accepting delivery are at least 21 years of age.

By placing an order on this Site, you authorize Ban Sum Wine & Liquor to appoint a common carrier on your behalf to deliver your order. By utilizing this service, you represent that you are in full compliance with applicable laws regarding the purchase, transport, and delivery of alcoholic beverages.

Ban Sum Wine & Liquor makes no representations regarding the legality of shipping alcoholic beverages to your state. You acknowledge and agree that you are solely responsible for compliance with all laws governing such shipments and agree to indemnify and hold harmless Ban Sum Wine & Liquor, its officers, agents, employees, and affiliates from any claims, damages, or liabilities arising from the shipment of alcoholic beverages to your state.

Change in Shipping Laws

If, after placing an order but before shipment, your state enacts laws prohibiting the importation of alcoholic beverages, you may request a refund by providing Ban Sum Wine & Liquor and its counsel with proof of such legal change. All returns must comply with New York law; returns across state lines are not permitted. Once an order has shipped, title passes to you and no refund can be issued.

Shipment Method, Timing, and Delivery

All products ship from New York. While Ban Sum Wine & Liquor endeavors to fulfill orders promptly, standard processing time is approximately one (1) to five (5) business days, and delivery may take eight (8) to ten (10) days. Shipping charges are calculated based on weight, destination, and delivery method.

An adult signature (21 years or older) is required upon delivery. Deliveries will not be left unattended. Customers must inspect their order upon receipt. Missing or incorrect items must be reported within three (3) business days of delivery.

In the event an incorrect item is shipped, you must email Ban Sum Wine & Liquor with a photo of the sealed bottle and your order confirmation. If you do not receive a response within fourteen (14) days, please follow up from an alternate email address.

Failed Delivery Attempts

If delivery fails after the carrier’s allotted attempts and the package is returned to Ban Sum Wine & Liquor, a twenty-five percent (25%) restocking fee will be deducted from your refund. Shipping costs are nonrefundable. If the order qualified for free shipping, forty dollars ($40.00) will be deducted for shipping and handling. If the returned package is damaged, you are responsible for the full cost of the order.

Damaged Items

Ban Sum Wine & Liquor takes all reasonable precautions to ensure that your order is properly packaged and protected. Orders are shipped in durable boxes with protective foam cushioning. Items with original manufacturer packaging or non-standard bottles are packed securely at Ban Sum Wine & Liquor’s discretion. During periods of extreme weather, it is your responsibility to notify Ban Sum Wine & Liquor if you wish to postpone shipment.

Limitation of Liability

Ban Sum Wine & Liquor shall not be liable under any legal theory, whether in tort (including negligence), contract, or otherwise, for any incidental, consequential, indirect, special, or punitive damages arising out of your use of the Website or purchase of goods, regardless of notice of such possibility.

Ban Sum Wine & Liquor reserves the right to modify any Website information at its sole discretion. YOUR SOLE AND EXCLUSIVE REMEDY AGAINST BAN SUM WINE & LIQUOR IS TO CEASE USING THE SITE. DAMAGES AGAINST BAN SUM WINE & LIQUOR SHALL BE LIMITED TO THE DOLLAR VALUE OF YOUR ORDER.

Disclaimer of Warranties

While Ban Sum Wine & Liquor endeavors to maintain accurate Website information, inadvertent typographical or factual errors may occur. The Website and all information contained herein are provided “AS IS,” without any warranty, express or implied, including warranties of merchantability or fitness for a particular purpose.

Force Majeure

Ban Sum Wine & Liquor shall not be deemed in default or breach of this policy for delays or failures resulting from causes beyond its reasonable control, including acts of God, governmental actions, civil disturbances, wars, labor disputes, fires, or other events of force majeure.

All Sales Final

All sales are final. If you request to cancel an order that has not yet been packaged or shipped, Ban Sum Wine & Liquor may, at its sole discretion, issue a refund subject to a ten percent (10%) restocking fee.

Legality and Validity

If any provision of these terms and conditions is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, such determination shall not affect the validity or enforceability of any remaining provisions. The parties shall endeavor to give effect to the intent of the invalidated provision to the fullest extent permitted by law.
